These Terms of Use (“Terms”) govern your use of the VidJump mobile application (the “App”) provided by Karhu Media, LLC (“Karhu Media”, “we”, “us”). By downloading or using the App, you agree to these Terms.
1. The App
VidJump enables coaches to record short video clips and transfer them to paired devices for athlete review. The App may compress video on-device and use network services (including Apple CloudKit and your cellular/Wi‑Fi connection) to deliver transfers.
2. Eligibility
You must be able to form a legally binding contract to use the App. If you use the App on behalf of a club or organization, you represent you have authority to bind that organization to these Terms.
3. Account and security
Some features may require an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
4. Video content and permissions
You are responsible for the videos you record, upload, transfer, or share using the App. You must have the necessary rights and permissions to record athletes and transfer their videos, including any required consents from athletes, parents/guardians, or organizations. Do not use the App to record or share unlawful, infringing, or harmful content.
5. Acceptable use
You agree not to: (a) misuse the App or interfere with its operation, (b) attempt to reverse engineer or bypass security, (c) use the App to transmit malware or exploit vulnerabilities, or (d) violate any applicable laws, rules, or third‑party rights.
6. Subscriptions, trials, and purchases
The “Coach (Camera)” mode is free. The “Athlete (Display)” mode requires an auto‑renewing subscription (with a trial period where offered). Subscription prices are shown in the App and vary by region.
Payments are processed by Apple via In‑App Purchase. Your subscription renews automatically unless you cancel at least 24 hours before the end of the current billing period. Your Apple account will be charged for renewal within 24 hours prior to the end of the current billing period. You can manage or cancel subscriptions in your Apple ID account settings. Any unused portion of a free trial will be forfeited upon subscription purchase.
7. No guarantee of availability
We may change, suspend, or discontinue the App (or any part of it) at any time, including removing it from app stores or ending support for certain devices or platforms. If the App is discontinued, we are not obligated to provide refunds except as required by law or by Apple’s policies. Refund requests (if available) are handled by Apple.
8. Network and device requirements
The App requires compatible iOS devices and relies on network connectivity. Transfer speed and reliability depend on your devices, settings, and network conditions. You are responsible for any data charges from your carrier.
9. Intellectual property
The App and all related intellectual property are owned by Karhu Media or its licensors. Subject to these Terms, we grant you a limited, non‑exclusive, non‑transferable license to use the App for your personal or internal organizational use.
10. Third‑party services
The App integrates third‑party services such as Firebase, Apple services (including CloudKit and APNs), Qonversion, and Mailchimp. Your use of those services may be governed by their terms and policies. Apple is not a party to these Terms, except as required under App Store rules.
11. Disclaimer
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KARHU MEDIA WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE APP. IN ALL CASES, OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID (IF ANY) FOR THE APP’S SUBSCRIPTION DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
13. Indemnity
You agree to defend, indemnify, and hold harmless Karhu Media from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the App, your content, or your violation of these Terms.
14. Changes to these Terms
We may update these Terms from time to time. We will update the effective date above and may provide additional notice in the App. Your continued use of the App after changes means you accept the updated Terms.
15. Governing law
These Terms are governed by the laws of the United States and the State of Colorado, without regard to conflict of laws rules, except where local consumer protection laws require otherwise.
